Desde que el profesor de derecho Lawrence Lessig creara este concepto en 2001, y tras su implantación en 2003 en España a través de la Universidad de Barcelona, las licencias Creative Commons se han convertido en una alternativa real al Copyright, y sobre todo en una herramienta muy útil para aquellos artistas que pretenden darse a conocer al gran público. La creatividad es la gran beneficiada de la utilización (por suerte cada vez mayor) de este tipo de licencias cuya finalidad es principalmente hacer desaparecer las barreras de acceso a la cultura. Sin embargo siguen surgiendo dudas acerca de las licencias Creative Commons. Por ello, queremos revisar algunas de las más frecuentes que nos han llegado a plantear distintos participantes del FIVECC:
Since the law professor Lawrence Lessig created this concept in 2001, and following its implementation in 2003 in Spain through the University of Barcelona, Creative Commons licences have become a real alternative to Copyright, and above all a very useful tool for artists wishing to make themselves known to the great public. Creativity is the major beneficiary of the use (which is fortunately becoming increasingly widespread) of these kinds of licences which mainly aim to bring down barriers to culture. However, there are still questions about Creative Commons licences. So we wanted to go through a few of the most frequently asked questions by the participants of FIVECC:
¿Qué debo hacer para incluir en mi videoclip (temporalmente o no) la licencia Creative Commons? / What must I do to include the Creative Commons licence in my music video (temporarily or otherwise)?
Basta simplemente con incluir el logotipo de la licencia CC en la carátula del CD/DVD o en los créditos del videoclip. Para saber más sobre la licencia y conseguir cualquiera de los logos que existen en función del uso que quieras que se haga de tu trabajo lo mejor es consultar el apartado correspondiente de la propia web de las licencias Creative Commons. En FIVECC, como en CAMON, creemos firmemente que el uso de las licencias Creative Commons puede contribuir a la difusión de una obra y por tanto de la cultura. Y por eso solo aceptamos videoclips bajo licencia CC en nuestro concurso. Al distribuir tu trabajo bajo una licencia CC, antes que nada estás asegurando la autoría del mismo.
All you have to do is include the logo of the CC licence on the cover of the CD/DVD or in the credits to the music video. To find out more about the licence or get any of the logos available depending on the use you wish to make of your work, the best thing is to view the corresponding section of the Creative Commons licensing website. In FIVECC, and in CAMON, we firmly believe that the use of Creative Commons licences can help to spread creative work and therefore culture. And so we only accept music videos submitted to our competition if they have a CC licence. By distributing your work under a CC licence, first and foremost you are guaranteeing its authorship.
¿Estas licencias entran en conflicto con los derechos de autor tradicionales? / Do these licences come into conflict with traditional copyright?
No. Estas licencias permiten a los creadores ceder algunos derechos sobre las obras pero con ciertas condiciones y manteniendo siempre la autoría. Además los creadores pueden elegir a su gusto la licencia más adecuada según sus necesidades.
No. These licences enable creators to grant certain rights to their work but with certain conditions and always maintaining authorship. Furthermore, creators can choose the licence that best suits their needs.
¿Es incompatible la licencia no comercial con seguir ganando dinero por otras vías? / Is the non-commercial licence incompatible with continuing to earn money through other channels?
Por supuesto que no. La condición de ‘uso no comercial’ sólo se aplica a quien use o disfrute de tu trabajo, no a ti (que para eso eres el creador). Uno de los objetivos de este tipo de licencias es aumentar al máximo la distribución de sus obras manteniendo a la vez el control sobre los aspectos económicos. Pongamos de nuevo el ejemplo del FIVECC: si tu videoclip inscrito en el festival está bajo una licencia CC no comercial, nosotros podremos subirlo a nuestra web, proyectarlo en el concierto y la fiesta final pero, por ejemplo, no podremos sacar a la venta un DVD con los 30 mejores vídeos del FIVECC sin vuestro permiso. Así de fácil.
Of course not. The ‘non-commercial use’ condition is only applied to those who use or enjoy your work, not to you (that’s why you’re the creator). One of the objectives of these kinds of licences is to maximise the distribution of your work whilst allowing to you retain control over the economic aspects. We would point to the example of FIVECC once again: if the music video you submit to the festival has a non-commercial CC licence, we can upload it onto our website, show it at the concert and the final party but, for example, we could not release a DVD for sale with the best 30 videos from FIVECC without your permission. It’s that easy.
¿Puedo participar en el FIVECC si tengo registrada la música en la SGAE? / Can I take part in FIVECC if I have music registered with SGAE?
Lo que tenéis que registrar como CC no es la música, sino el videoclip, que es otro formato creativo. Y ello no implica interferencias. Por tanto… sí, puedes participar sin problemas.
What you have to register with a CC licence is not the music, but the music video, which is a different creative format. And that does not imply interference. Therefore… yes, you can take part without any problem.
Tras participar en el FIVECC quiero blindar mi obra con un copyright; ¿se puede hacer? / After taking part in FIVECC I want to protect my work with copyright; can I do that?
Sí, puedes hacerlo. Que nosotros queramos difundir la idea de una cultura más libre y que no perjudica a los autores, no implica una obligación para con todos los participantes. Es una cuestión de criterio. Para participar tendrás que poner tu obra bajo la licencia CC correspondiente, si después quieres utilizar otro tipo de protección legal más restrictiva puedes hacerlo sin problemas.
Yes, you can. The fact that we want to spread the idea of a freer culture which does not damage authors does not imply an obligation for all participants. It’s a question of criteria. To take part, you must apply the corresponding CC licence to your work; if afterwards you wish to apply a different kind of more restrictive legal protection, you can do so without any problems.
